Assault and Battery

The offense of assault or assault and battery is codified at Code of Virginia §18.2-57.  It is a Class 1 misdemeanor. Judges and Commonwealth’s Attorney take assault and battery charges very seriously and an offender is facing the possibility of jail for an assault and battery conviction.  Additionally, as a violent crime is carries lifelong consequences on background checks.  There are numerous legal and technical defenses to assault and battery charges.
