DUI Second Offense Penalty in Virginia
Pursuant to Virginia Code 18.2-270, the penalty for a DUI second offense is:
- 2nd Offense w/5 years – Class 1 Misdemeanor
- Up to 12 months jail and/or $2,500 fine
- 12 month suspended/restricted license
- 12 month VASAP, drug and alcohol free
- 6 month ignition interlock
- $500 fine mandatory minimum
- 20 days mandatory minimum
- 2nd Offense w/5-10 years – Class 1 Misdemeanor
- Up to 12 months jail and/or $2,500 fine
- 12 month suspended/restricted license
- 12 month VASAP, drug and alcohol free
- 6 month ignition interlock
- $500 fine mandatory minimum
- 10 days mandatory minimum
- 2nd Offense w/10 years – Class 1 Misdemeanor
- Up to 12 months jail and/or $2,500 fine
- 12 month suspended/restricted license
- 12 month VASAP, drug and alcohol free
- 6 month ignition interlock
- $500 fine mandatory minimum
- >0.15 <0.20 – 10 days mandatory minimum
- >0.20 – 20 days mandatory minimum
